Terms of Service ​

This English translation is provided for convenience only. The Mongolian version is the legally binding text.

1. General Provisions ​

These Terms of Service define the rights and obligations of users in connection with the use of the Byl service (hereinafter the "Service") developed by Kite Lab Development LLC (hereinafter "we").

Byl is a SaaS service that enables developers to easily integrate a wide range of digital payment solutions.

By registering as a user of the Byl service and using it, you agree to these terms and must comply with them while using the Service.

2. Terms of Service ​

2.1. Right to Use the Service ​

  • The user is responsible for creating a Byl account and providing accurate and truthful information.
  • When registering for the Service, the user must fully complete the KYC (Know Your Customer) verification set out in the "Verified Business Requirements". Unverified users are offered a limited version of the Service.
  • The user must be at least 18 years of age to use the Service. Liability arising from the actions of a minor user shall be borne by that user's legal guardian.
  • The Service may only be used for lawful, permitted purposes.
  • The user is responsible for keeping their account and related credentials confidential and must not disclose them to third parties.

2.2. Transaction Handling ​

  • Byl does not receive user revenue into its own accounts; payments are routed directly to the user's own bank account.
  • The user obtains QPay merchant status in their own name, and Byl does not store payment information.
  • Byl regularly monitors transaction patterns and user activity, and reserves the right to temporarily suspend or permanently terminate a user's access if suspicious transactions (potentially related to fraud or illegal activity) are detected.
  • The user bears full responsibility for transactions made through QPay or other payment systems, and is obliged to provide Byl with any necessary information regarding a transaction (such as payment receipts).

2.3. Prohibited Activities ​

Using the Byl service for any of the following is strictly prohibited:

  • Conducting illegal, fraudulent, or deceptive activities
  • Engaging in corruption, money laundering, or terrorism financing
  • Using payment systems without authorization or attempting to hack them
  • Services related to adding fake followers, likes, or comments on third-party platforms (Facebook, Instagram, etc.), or using bots
  • Selling social media accounts or providing unauthorized access ("hacking") services
  • Selling counterfeit products or services (making promises that will not be fulfilled)
  • Unlicensed gambling or betting services
  • Promoting content or activities that violate public morals
  • Selling adult content or illegal goods (narcotics, weapons, etc.)
  • Deceiving minors, or engaging in actions that cause harm to their personal data or finances, is strictly prohibited
  • Selling counterfeit coupons or discount codes
  • Phishing or services that collect users' personal data
  • Distributing illegal software or content (cracked software, materials infringing intellectual property rights)

If a user is found to be engaging in any of the prohibited activities listed above, Byl reserves the right to immediately terminate the user's access.

2.4. Liability ​

  • Byl monitors the activity of users registered on the platform and will take action to stop any violations that are detected. Nevertheless, the user bears full responsibility for their own actions and payment transactions.
  • Merchant users bear full responsibility for any damages related to their own business activities.
  • The user shall resolve any transaction disputes with third parties (such as QPay) on their own, and Byl cannot be held liable in this regard.

2.5. Changes and Updates ​

  • Byl reserves the right to update these Terms of Service and will notify users of the updated terms in advance.
  • If the user does not accept the new terms, they have the right to stop using the Service.

2.6. Data Protection and Privacy ​

  • User data is protected in accordance with our Privacy Policy.
  • Byl does not share users' personal or payment information with third parties.
  • The user is responsible for protecting their login credentials and password, and bears liability for any breach arising from failure to do so.

2.7. Complaint Handling ​

  • Byl will acknowledge complaints received from users or third parties within 48 hours and initiate an investigation.
  • If supporting evidence (payment statements, chat history, etc.) is provided with a complaint, the investigation will be completed more quickly.
  • If a violation is confirmed, measures may be taken up to and including temporary suspension or permanent termination of the merchant's access.
  • Complaints are kept confidential and are shared with relevant authorities only when necessary.

3. Termination and Cancellation of the Service ​

  • The user may close their account at any time.
  • Byl reserves the right to terminate an account if it determines that the user has violated these Terms of Service.
  • Any dispute arising in connection with the termination of the Service shall be resolved in accordance with the law.
